On Monday, legal representatives for Germany appeared before the International Court of Justice (ICJ) in The Hague to request the dismissal of a case initiated by Nicaragua. The proceedings, which began in March 2024, allege that Germany has enabled violations of international law and facilitated genocide in Gaza by providing military support to Israel.

During the session, Germany’s legal team argued that the ICJ does not have jurisdiction over the matter. Berlin’s primary defense is that Nicaragua failed to establish the existence of a formal legal dispute between the two nations prior to filing the case. Furthermore, Germany contended that Nicaragua’s conduct suggests the country was not genuinely interested in engaging in diplomatic dialogue or hearing Germany’s position before escalating the matter to the UN’s supreme judicial body.

The case highlights the ongoing international legal scrutiny regarding the actions of nations providing military assistance to Israel during the conflict in Gaza. While Nicaragua seeks to hold Germany accountable for its role in the conflict, Germany maintains that the case is procedurally flawed and lacks the necessary legal foundation to proceed to a full hearing on the merits of the genocide allegations.
