A man in Taiwan has received a prison sentence for illegally recording his wife’s extramarital affair, despite successfully using the footage to win a civil lawsuit against her. The man, who married in 2021, became suspicious of his wife’s behavior after finding a used toothbrush at their holiday home in September 2023. To confirm his suspicions, he placed a robot vacuum cleaner equipped with a recording device in the home.

The recordings captured audio of the wife engaging in sexual activity with another man. The husband subsequently used this audio as evidence in a civil court case to sue his wife for damages related to the affair. While the civil court accepted the evidence and ruled in the husband's favor, the wife filed a separate criminal complaint against him for violating Taiwan’s privacy and surveillance laws.

Under Taiwan’s legal framework, the unauthorized recording of private conversations is a criminal offense. The criminal court determined that the husband’s actions were a clear breach of his wife's right to privacy, regardless of the marital context or the validity of his suspicions regarding the affair. Consequently, the man was sentenced to jail time. The case highlights the complex intersection of family law and privacy rights in Taiwan, where evidence obtained through illicit surveillance can lead to criminal liability for the person who gathered it, even if the underlying claim of infidelity is proven true.
